Terms of Service

1. Acceptance of Terms

By accessing or using FinCom ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Not Financial Advice

Nothing on FinCom constitutes financial advice, investment advice, trading advice, or any other type of advice. All content posted by users, including portfolio data, returns, positions, commentary, and analysis, is for informational and entertainment purposes only.

FinCom does not recommend or endorse any specific investments, securities, brokerages, or financial strategies. Past performance displayed on the platform does not guarantee future results. All investing involves risk, including the possible loss of principal.

You should consult a qualified financial advisor before making any investment decisions. FinCom is not a registered investment advisor, broker-dealer, or financial planner.

3. Eligibility

You must be at least 18 years old to use the Service. By using FinCom, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into this agreement. Users in jurisdictions where such services are restricted are prohibited from using the Service.

4. Account Registration

You must create an account to access most features. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Brokerage Account Linking

FinCom allows you to connect brokerage and financial accounts through Plaid, a third-party data aggregation service. By linking your accounts, you agree to the following:

• You authorize FinCom and Plaid to access your financial account data in read-only mode
• FinCom will never initiate transactions, move funds, or modify your financial accounts
• Your financial credentials are transmitted directly to Plaid and are never stored by FinCom
• You are solely responsible for the accuracy of data displayed, which depends on your financial institution's data feeds
• You may disconnect your accounts at any time through the Settings page
• Linking your account does not create a fiduciary relationship with FinCom

By linking a brokerage account, you also agree to Plaid's Terms of Service and Privacy Policy.

6. Portfolio Data and Verification

FinCom displays verified portfolio data alongside user posts and profiles. By connecting your brokerage account, you consent to having your portfolio metrics (returns, positions, portfolio value) displayed on the platform, subject to your privacy settings. You can control what data is publicly visible through your account settings.

While FinCom verifies that connected data comes from a real brokerage account, we cannot guarantee the accuracy of all displayed figures due to delays, data feed issues, or discrepancies from financial institutions. Verified data should not be relied upon for financial decisions.

7. User Content

You retain ownership of content you post. By posting content on FinCom, you grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content on the platform. You represent that your content does not violate any third-party rights.

You agree not to post content that:

• Constitutes investment advice or securities recommendations presented as professional guidance
• Involves market manipulation, pump-and-dump schemes, or coordinated trading activity
• Is false, misleading, or deceptive about your portfolio performance or positions
• Harasses, threatens, or defames other users
• Violates any applicable laws or regulations, including securities laws
• Contains spam, malware, or unauthorized commercial solicitations

8. Securities Law Compliance

Users are solely responsible for ensuring their activity on FinCom complies with applicable securities laws. This includes laws relating to insider trading, material non-public information (MNPI), and market manipulation. Do not post about securities for which you possess material non-public information. FinCom is not responsible for users' compliance with securities laws.

9. Beta Service

FinCom is currently in beta. The Service is provided "as is" and may contain bugs, errors, or interruptions. Features may change, be removed, or be discontinued without notice. We do not guarantee uptime, data persistence, or feature availability during the beta period.

10. Limitation of Liability

To the fullest extent permitted by law, FinCom and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment returns, arising from your use of the Service. Our total liability to you for any claims shall not exceed $100.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time through the Settings page. Upon termination, your public posts may remain on the platform.

13. Governing Law

These Terms shall be governed by the laws of the United States and the state in which FinCom is operated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration rather than in court, except where prohibited by law.
